Purpose Of The Role

This role strategically manages all litigation, arbitration, and critical correspondence related to PSC accounts. The primary objective is to protect KE's commercial interests by ensuring all outgoing communication is precise, legally sound, and timely, thereby mitigating risk, recovering bad debts, and ensuring that written documentation—the definitive version of truth in public sector engagements—accurately reflects KE's position. This role is responsible for the entire PSC correspondence department, a critical function for maintaining formal and auditable stakeholder communication.

Key Responsibilities

  • Strategic Management of PSC Correspondence & Documentation
  • Own and oversee the entire workflow of the PSC Correspondence wing, ensuring it operates as a central, critical function for all PSC engagement.
  • Ensure all outgoing correspondence to public sector entities (letters, notices, agreements) is meticulously drafted, professionally presented, and comprehensively protects KE's interests.
  • Institute and manage a robust system for issuing timely payment reminders, disconnection notices, and final demands in strict adherence to SOPs and regulatory guidelines.
  • Maintain a formal, auditable record of all communication, establishing a clear and defensible paper trail for all interactions.
  • Disputed Revenue & Disconnection Management
  • Develop and implement strategies for the recovery of disputed revenues from public sector defaulters.
  • Oversee disconnection and reconnection actions for PSC accounts, ensuring all actions are justified by documented correspondence and comply with organizational policies.
  • Liaise with relevant Civic and Government Authorities to execute recovery actions and form a cooperative working environment.
  • Litigation, Arbitration & Out-of-Court Settlements
  • Manage a portfolio of litigation cases involving PSC accounts at various forums (Courts, NEPRA, Ombudsman, etc.).
  • Work closely with the Legal Affairs department to provide critical insights and information for crafting robust legal responses and arguments.
  • Employ advanced negotiation and mediation skills to achieve favorable out-of-court settlements, reducing legal costs and time.
  • Act as the primary focal point between KE and public sector entities to resolve issues pertaining to billing, operations, and other disputes.
  • Reporting, Contract Review & Performance Analysis
  • Monitor, analyze, and report on the performance of the recovery and correspondence cycle against set KPIs and business targets.
  • Review contracts and agreements with public sector customers to identify potential risks, ensure compliance, and recommend mitigating strategies.
  • Analyze the implications of court orders and regulatory decisions on KE’s operations and financial performance.
  • Investigations & Risk Mitigation
  • Conduct thorough investigations into disputes by gathering evidence, analyzing data, and interviewing relevant parties to determine root causes.
  • Develop strategies to address identified issues and prevent future disputes.
  • HSE & Team Management
  • Ensure functional and operational adherence to health, safety, and environmental (HSE) policies within the team's activities.
  • Facilitate safety trainings and promote a culture of safety and well-being for all staff.
  • General Duties
  • Perform any other tasks and responsibilities as assigned by the line manager or department head, which are aligned with the overall objectives of the role and the organization.

Qualifications & Experience

  • Bachelor’s degree in Law or a related field. A Master’s degree will be preferred.
  • Minimum 5 years of relevant experience in dispute resolution, litigation management, corporate correspondence, or managing public sector accounts.
  • Proven experience in contract review, legal documentation, and managing a high-volume, critical correspondence function.
  • In-depth knowledge of the regulatory environment and experience liaising with government bodies.
